LICENSE AGREEMENT

GRANT OF LICENSE, MSK grants you the right to use one copy of Flash Back (the "SOFTWARE") personally on one computer only, or on a single workstation used non-simultaneously by multiple people, but not both. You may access the SOFTWARE through a network, provided that you have obtained individual licenses for the software covering all workstations that will access the SOFTWARE through the network. For instance, if six different workstations will access the SOFTWARE on the network, each workstation must have its own SOFTWARE license regardless of whether they use the SOFTWARE at different times or concurrently.

COPYRIGHT, The SOFTWARE is owned by MSK. You must treat the SOFTWARE like any other copyrighted material (e.g. a book or musical recording) except that you may either:
Make one copy of the SOFTWARE solely for Backup or Archive purposes OR
Transfer the SOFTWARE to a single hard disk provided you keep the original for Backup or Archive purposes. You may not copy the written materials accompanying the SOFTWARE.

OTHER RESTRICTIONS, you may not rent or lease the SOFTWARE. You may transfer the SOFTWARE and accompanying written materials on a permanent basis provided you retain no copies and the recipient agrees to the terms of this agreement. You may not reverse engineer, decompile or disassemble the SOFTWARE. In the case of the SOFTWARE being an updated version, any transfer must include the update and all prior versions.
LIMITED WARRANTY

LIMITED WARRANTY - MSK warrants that the original disks are free from defects for 90 days from the date of delivery of the SOFTWARE.

CUSTOMER REMEDIES - MSK's entire liability and your exclusive remedy shall be at MSK's opinion. Either a) return of the price paid or b) replacement of the SOFTWARE which does not need MSK's Limited Warranty and which is returned to MSK with a copy of your receipt. Any replacement of the SOFTWARE will be warranted for the remainder of the original warranty period or 30 days, whichever is greater.

NO OTHER WARRANTIES - MSK's disclaims all other warranties, either expressed or implied. Including but not limited to implied warranties of merchantability and fitness for a particular purpose, with respect to the SOFTWARE and the accompanying written material. This limited warranty gives you specific legal rights and does not affect your statutory rights.

NO LIABLILITY FOR CONSEQUENTIAL DAMAGES - In no event shall MSK or its suppliers be liable for any damage whatsoever (including; without limitation, damages for loss of business profits, business interruption, or other pecuniary loss) arising out of the use, misuse of or inability to use the SOFTWARE.
